Terms & Conditions
Effective date: 23 September 2026 · Last updated: 26 September 2026
These Terms & Conditions govern your access to and use of Nest. Please read them carefully before using the service.
1. Who we are
Nest is operated from Malta under the trading name Nest ("Nest", "we", "us" or "our"). You can contact us at support@nest.com.mt.
Nest provides property information, automated property analysis, property comparison tools and, where available, services that allow property owners or authorised representatives to request contact from Agency Partners. These Terms apply to the Nest website, accounts, property reports, Rate a Deal tools, owner valuation tools, agency introduction services and other features we make available from time to time.
Our Privacy Policy explains how we collect and use personal data. Our Cookie Policy explains cookies and similar technologies.
By creating an account, purchasing a subscription, requesting an agency introduction or otherwise using Nest, you agree to these Terms. If you do not agree, do not use Nest.
2. What Nest provides
Nest helps users:
- explore property information in Malta and Gozo;
- compare properties with available property listings;
- obtain indicative property value estimates;
- analyse asking prices and comparable properties;
- estimate potential rents, yields and other property-related scenarios;
- assess properties through tools such as Rate a Deal;
- monitor or review property information where that functionality is available; and
- where available, request contact from Agency Partners.
Nest is primarily an information and technology service. Unless we expressly tell you otherwise, Nest does not act as:
- an estate agent or property broker;
- a property valuer, architect or surveyor;
- a notary or lawyer;
- an accountant or tax adviser; or
- a financial adviser, lender or investment adviser.
An introduction to a third-party agency or professional does not change this.
3. Property estimates and automated reports
3.1 Indicative information only
Property estimates, price comparisons, ratings, deal scores, rental estimates, yields, investment scenarios and other automated outputs provided by Nest are indicative estimates and general information only. A Nest report is not:
- a certified property valuation or a bank or lending valuation;
- a physical property inspection, architect’s or surveyor’s report, or structural assessment;
- a title search or planning or permit verification; or
- legal, tax, financial or investment advice.
An appraisal or opinion subsequently provided by an estate agency is also not necessarily a certified or bank-accepted valuation. Confirm with the relevant professional what their assessment covers.
3.2 How estimates are produced
Nest estimates may use information supplied by you; listings, asking prices and comparable properties; historical and location information; property characteristics; third-party or publicly accessible data; our database; statistical or automated models; and assumptions used by our valuation methodology. The exact methodology may evolve as our data, models and service improve.
3.3 Asking prices are not transaction prices
Listings generally show advertised asking prices. These do not necessarily represent a seller’s accepted price, a final transaction price, market value, a bank-accepted or certified valuation, or the price at which a similar property will sell. Treat comparable listings as evidence and context, not confirmed transaction values unless expressly identified otherwise.
3.4 Limitations in property data
Property data may be incomplete, inaccurate, duplicated, outdated, changed, incorrectly described, removed, unavailable or not independently verified. Nest does not cover every property, listing or transaction in Malta or Gozo. Unless expressly stated otherwise, we do not physically inspect a property or independently verify every listing, photograph, measurement, asking price, description or other third-party detail.
3.5 Factors affecting property value
Value or attractiveness may be materially affected by exact location, street and surroundings, condition, finish, layout, internal and external area, floor level, accessibility, lift access, views, orientation, noise, natural light, parking, garages, outdoor space, tenure, ground rent, title, permits, planning, development restrictions, structure, common areas, financing, taxation, market conditions and characteristics that online data cannot reasonably identify. An automated report may not fully account for these.
3.6 Confidence levels
A Low, Medium, High or similar confidence indicator describes the strength and availability of the evidence behind an estimate, not a guarantee of accuracy. Low confidence may mean few sufficiently comparable listings are available.
3.7 Rental and investment illustrations
Rental estimates, yields, returns, costs and other financial scenarios depend on assumptions. Actual outcomes may differ materially because of vacancy, financing costs, interest rates, maintenance, insurance, taxation, agency fees, management costs, utilities, repairs, regulatory requirements, tenant behaviour and market changes. No sale price, rent, investment return, buyer, tenant, financing approval or completion date is guaranteed.
3.8 Your responsibility for decisions
You remain responsible for property decisions. Before buying, selling, letting, financing, developing or investing, verify material information and obtain appropriate independent professional advice. Do not rely on a Nest estimate, rating or report as the sole basis for a significant property or financial decision. Do not use a Nest estimate, score, rating, or any other of its services as an automated decision-making input.
4. Your information and submissions
4.1 Information you provide
You are responsible for the information, instructions, photographs, documents and other material you provide. Provide information accurate to the best of your knowledge and not knowingly or recklessly misleading. Correct substantially incorrect material information where reasonably possible.
4.2 Authority to submit property information
You may request an agency introduction only if you own the property or are authorised by its owner. By requesting one, you confirm your authority to make the request, provide property information and authorise disclosure of relevant contact and property information to your selected Agency Partners. A request does not appoint an agency, create an agency agreement, authorise a sale or letting, give exclusivity or oblige you to proceed.
4.3 Uploads
Only upload material you are entitled to provide. Unless specifically requested, do not upload identity documents, payment card information, bank account credentials, passwords, security codes, unnecessary information about others, photographs primarily depicting identifiable people or unrelated sensitive personal information.
4.4 Rights in your uploads
You retain ownership of uploads. You give Nest a non-exclusive licence to store, host, reproduce, process, analyse, display and, where needed for a service you requested, disclose that material to operate and provide Nest. This includes disclosure to your selected Agency Partners when you expressly request an introduction. It does not permit unrelated advertising use of your property photos without an appropriate legal basis or permission.
4.5 Reliance on information supplied by you
Nest may rely on what you provide when generating estimates, reports, comparisons, ratings, rental calculations and introductions. We are not responsible for an inaccurate output to the extent caused by your materially inaccurate, incomplete, misleading or outdated information, unless we knew or reasonably should have known it was incorrect.
5. Accounts and eligibility
You must be at least 18 to create an account, purchase a subscription or submit an agency introduction request. Keep your login credentials confidential and secure. Do not allow unauthorised access, impersonate someone, register with materially false information or access another person’s account without permission.
Tell us promptly at support@nest.com.mt if you reasonably believe your account has been accessed without authorisation. We may reasonably restrict access temporarily if we suspect account compromise, fraud or misuse.
6. Agency partners and introductions
6.1 Our agency partners
Nest works with participating estate agencies and property professionals ("Agency Partners") to help property owners connect with agencies that may be interested in providing a professional property appraisal or other estate agency services.
An agency described as a Nest partner has entered into, or participates under, a commercial arrangement with Nest.
The term "partner" describes this commercial relationship. Unless expressly agreed otherwise, it does not mean that Nest and the agency form a legal partnership, joint venture, employer-employee relationship or jointly controlled business.
6.2 Selecting an Agency Partner
Where the introduction service is available, Nest may allow you to select one or more Agency Partners that you would like to contact you.
Before you submit a request, we will identify the agencies selected and explain the relevant information that will be shared.
Your contact details will not be shared with an Agency Partner solely because you generated an automated Nest report. You must separately request or authorise the introduction.
Nest may review introduction requests before forwarding them. Submitting a request or selecting an Agency Partner does not guarantee that your request will be accepted or forwarded, or that an Agency Partner will contact you.
Nest reserves the right, acting reasonably and in accordance with applicable law, to decline, delay or withhold forwarding any request to some or all selected Agency Partners. Reasons may include incomplete or inaccurate information, eligibility concerns, suspected fraud or misuse, duplicate submissions, agency availability, property suitability, or other legitimate operational or commercial considerations. These examples are not exhaustive.
Unless required by law, Nest is not obliged to disclose its internal assessment criteria or provide a detailed explanation for its decision. Nothing in this section limits your statutory rights.
6.3 Our commercial relationship with Agency Partners
Nest may receive payment from Agency Partners in connection with the services we provide to them.
Depending on the commercial arrangement, this may include:
- subscription or platform fees;
- fees for qualifying or providing introductions;
- lead or referral fees;
- fees linked to an agency accepting or progressing an introduction; and/or
- a commission, revenue share or success fee where an introduction made through Nest results in a completed property transaction.
This means Nest may have a financial interest in an introduction resulting in business for an Agency Partner.
You do not pay Nest an agency commission merely because an Agency Partner pays Nest, unless a separate charge payable by you has been clearly disclosed and agreed with you in advance.
Any estate agency commission or other professional fee that you personally owe to an Agency Partner is governed by your separate agreement with that agency.
Where required by law, relevant brokerage, referral or commission arrangements will be disclosed or recorded in the appropriate transaction documentation.
6.4 Agency selection and recommendations
Nest may display Agency Partners based on factors including:
- property type;
- location;
- areas in which an agency operates;
- availability;
- stated expertise or coverage;
- user selections;
- service eligibility; and
- participation in the Nest Agency Partner service.
Unless expressly stated otherwise, inclusion on Nest does not mean that an agency is objectively the best agency available for you or that Nest has assessed every agency operating in the market.
6.5 Relationship between you, Nest and an Agency Partner
Nest facilitates the introduction between you and an Agency Partner and may receive payment if that introduction leads to business or a completed property transaction.
However, unless Nest expressly agrees otherwise, the Agency Partner provides its estate agency and professional services independently under its own agreement with you.
The Agency Partner is responsible for its own:
- property appraisal and professional opinions;
- advice and representations;
- property marketing;
- negotiations;
- viewings;
- communications with prospective buyers or tenants;
- regulatory and licensing obligations;
- anti-money-laundering and know-your-customer obligations applicable to it;
- professional conduct;
- fees and commissions;
- transaction documentation; and
- other services that it agrees to provide to you.
Nest's commercial interest in a successful introduction does not make Nest responsible for the professional advice, statements or conduct of an Agency Partner.
Nest remains responsible for Nest's own service, representations, processing of your information and other acts or omissions for which Nest is responsible under applicable law.
6.6 No guarantee of agency or transaction outcome
An introduction through Nest does not guarantee that an Agency Partner will:
- accept the opportunity;
- contact you;
- inspect the property;
- provide a particular valuation;
- recommend a particular asking price;
- take the property on;
- find a buyer or tenant;
- achieve a particular price;
- complete a transaction; or
- do so within a particular period.
You remain free to decide whether to appoint an Agency Partner following an introduction, subject to any agreement you subsequently enter into directly with that agency.
6.7 No obligation to appoint an Agency Partner
Requesting contact through Nest does not by itself:
- appoint an Agency Partner;
- create an estate agency agreement;
- give an Agency Partner exclusivity;
- oblige you to list the property;
- oblige you to accept an appraisal;
- oblige you to sell or let the property; or
- oblige you to enter into another contract.
Any appointment or exclusivity arrangement is agreed separately between you and the Agency Partner.
6.8 Cancelling an introduction
You may ask us at support@nest.com.mt to cancel an introduction before your information has been disclosed to the selected Agency Partner. Where practicable, we can prevent the introduction before disclosure.
Once information has already been shared, Nest cannot reverse that disclosure.
You may nevertheless ask the Agency Partner not to contact you further and exercise applicable rights under data protection law.
7. Acceptable use
Use Nest only lawfully. You must not:
- submit fraudulent or fictitious requests, impersonate anyone, or falsely claim ownership or authority;
- upload unlawful material or knowingly supply malware;
- bypass access controls, interfere with security, access another user’s data, attempt unauthorised system access, or disrupt or overload Nest;
- manipulate property data or estimates, or use Nest for fraud, misleading purposes or unlawful discrimination;
- misuse personal information obtained through Nest or violate another person’s intellectual property, privacy or confidentiality rights; or
- encourage another person to do any of these things.
8. Scraping, automated access and database protection
Without prior written permission, do not use robots, spiders, crawlers, scraping software, automated agents, browser automation, bulk extraction tools, unauthorised automated API calls or similar means to systematically access, extract, gather or reproduce Nest content.
In particular, do not systematically extract or reproduce listings, comparables, pricing or historical listing data, valuation results, reports, ratings, scores, property datasets or substantial parts of Nest’s database. Do not use Nest content without permission to build or enrich a competing property database, valuation or analytics service; resell data; republish substantial datasets; train, fine-tune or materially enrich a commercial machine-learning or AI model; create derivative commercial datasets; or bypass access restrictions.
This section does not restrict rights that cannot lawfully be restricted.
9. Reports and permitted use
Unless stated otherwise, a consumer Nest report is primarily for that user’s personal property research. You may share an unaltered report with professional advisers helping you with the property.
Do not alter it misleadingly, remove material assumptions, warnings, relevant dates or confidence information, selectively reproduce it to misrepresent its conclusion, claim it is certified, impersonate Nest, present it as your own certified professional analysis, or resell or systematically distribute reports commercially without permission. A material breach may cause us to withdraw your permission to use the relevant Nest material to the extent permitted by law.
10. Intellectual property
Nest and its licensors retain applicable intellectual property and database rights in the Nest name, branding, website design, software, interfaces, databases and structure, valuation methodology, proprietary calculations, original text and graphics, reports and their design, scoring systems and other original Nest content.
Receiving a report does not transfer ownership of Nest software, data, methodology, branding or third-party material. Third-party listings, trademarks and images remain subject to their owners’ rights. Your rights in your own uploads are described in section 4.4.
11. Charges, subscriptions and consumer rights
Getting an estimate, requesting an agency introduction and holding an account are free. The only paid consumer services are monthly subscriptions. Nest Plus costs €12.99 per month and includes 20 Rate a Deal analyses per month and access to complete comparable listings and their original source links across Owner Valuation and Rate a Deal reports. Source listings are maintained by third parties and may change, be updated or become unavailable; a subscription gives access to Nest’s comparable evidence and any available source links, not ownership of third-party data or a guarantee that a listing remains available. Plan details and any other features are shown on our pricing page. Prices in euro and allowances are shown there before you order; checkout shows the amount charged by the payment provider.
Subscriptions recur monthly until cancelled. If you have a Stripe subscription, you can open the Stripe billing portal using Manage billing on the pricing page; available cancellation options and their effective dates are as shown there. You can also contact support@nest.com.mt about cancellation. If you cancel, your subscription stops renewing and paid access continues until the end of the current paid billing period, after which your account returns to the free plan. Your saved reports are kept. Report allowances reset at the start of each calendar month (or after a later manual account reset), independently of the subscription renewal date. Unused reports do not carry over. A plan described as unlimited is subject to reasonable fair use.
Except where required by law or expressly agreed otherwise, subscription fees already charged are not refundable merely because you did not use the service, used only part of your report allowance or cancelled before the end of a paid period. Mandatory rights relating to withdrawal, non-conforming digital services, incorrect charges, failure to provide a purchased service and other statutory consumer remedies remain unaffected. Immediate digital delivery or early service performance does not automatically remove withdrawal rights; any required request, consent and acknowledgement must be obtained separately in the purchase flow. No new charge applies retrospectively to an agreed free service without notice and, where required, your agreement.
12. Availability, restrictions and termination
We may maintain, improve or correct the service. We may proportionately restrict access to address fraud, security threats, unlawful use or material breaches. Where practicable and lawful, we explain why and give you an opportunity to resolve the issue; urgent protective action may be immediate.
We will give reasonable notice of material changes affecting an ongoing service where possible and preserve applicable rights for services already purchased. You may stop using Nest and request account closure; legally required records or information needed for legitimate claims may be retained as explained in our Privacy Policy.
13. Responsibility and liability
We are responsible for losses caused by our breach of these Terms or failure to exercise legally required care, to the extent required by law. We do not guarantee outcomes dependent on market conditions, inaccurate third-party information or independent agencies, but remain responsible for our own acts and omissions.
Nest reports describe information available when created and are not certified valuations. We are not responsible for losses from relying on a report instead of obtaining appropriate independent professional advice, except where the law does not allow that responsibility to be limited or the loss results from our own breach, negligence or failure of care.
To the extent permitted by law, we are not responsible for unforeseeable losses, business losses from a private consumer service, or independent third parties’ acts, omissions or advice. Any lawful limitation for a paid subscription must be proportionate and leave a meaningful remedy.
Nothing excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury where it cannot lawfully be excluded, or any other non-excludable liability. Mandatory consumer and data protection rights remain.
You remain responsible for information and material you submit and must comply with the acceptable-use and report-integrity rules above. Deliberate fraud, unlawful conduct and serious misuse may lead to proportionate restrictions on access and any remedies available under applicable law. This does not require you to indemnify Nest for third-party claims or transfer to you responsibility for Nest’s own acts, omissions or legal obligations.
14. Complaints, changes and applicable law
Send complaints to support@nest.com.mt with the relevant report or request reference. We will investigate and respond within a reasonable time. You retain access to courts, regulators and applicable dispute resolution without first completing our process.
We may update these Terms for changes to the service or law, publish the new version and notify users of material changes affecting an ongoing contract, obtaining agreement where required. Changes do not retrospectively remove accrued rights. If a provision is unenforceable, the rest continues where legally possible.
Maltese law governs these Terms without depriving consumers of mandatory protections of their country of habitual residence where applicable. Jurisdiction follows applicable law; consumers need not give up courts available under mandatory rules.
